Section III: Legal, economic, financial and technical information
III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required: For each specific contract
above EUR 300 000, a performance guarantee shall be constituted by
deductions of 10 % from each interim payment. It shall be discharged by
payment of the balance. It shall cover the satisfactory completion of the
specific contract. In the event of default, delay, and/or defective
performance of the contract, the Commission will be entitled to such
penalties and liquidated damages, as defined in point 6.3.3 of the tender
specifications, to make good its losses, in particular by deducting the
relevant amount from invoices and, if necessary, from the performance
guarantee.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Payment of 20 % of
the total amount of each specific contract following approval by the
Commission of the first interim deliverable payment of 40 % of the total
amount of each specific contract following approval by the Commission of
the second interim deliverable payment of 40 % of the total amount of each
specific contract following approval by the Commission of the final
deliverable.

Lot 2: Cereals, oilseeds and protein crops (COP). 2 offers were received
by the deadline set out in the tender specification. The offers were
assessed by the evaluation committee and both of them were declared
eligible with regards to the results of assessing the quality of the
offers. However, given that, on the one hand, the corrected price offer
for the study simulation of one of the offers exceeded the maximum
threshold set out in section 9.3.2 of the terms of reference, and, on the
other hand, the other offer did not fulfil the requirements of the terms
of reference (section 8.4), both offers were rejected.

Lot 7: Starch, sugar and cotton. 2 offers were received by the deadline
set out in the tender specification. The offers were assessed by the
Commission against the exclusion, selection and award criteria. Both of
them were declared eligible with respect to the exclusion and selection
criteria. However, with respect to the award criteria, 1 offer was
assessed to be below average quality, and received an average quotation
below the threshold of 60 points in total. Therefore, in accordance with §
9.3.1 of the tender specifications, this offer had to be rejected. As a
result, only 1 offer was declared eligible in terms of quality. As
foreseen in section 9.3.2 of the tender specification, this offer was
assessed against the price criteria. By applying the offered unit prices
to the simulated evaluation study, it was discovered that the maximum
threshold set out in section 9.3.2 of the tender specification was
exceeded. Therefore, this offer had to be rejected as well.
