Contract specifications
6. Contract description: The contract comprises the execution of works
foreseen in the framework of rehabilitation of Basin XX (clearing of zones
prone to flooding, drainage canals, crossing structures, interconnection).
Basin XX is located in the western suburbs of Cotonou, mostly in the
Cotonou municipality, and a small section in the Abomey-Calavi
municipality. It extends over an area of 535 hectares. The basin is linked
to Lake Nokoué to the north of Cotonou.
7. Number and titles of lots: The contract is divided into 2 lots, each
made up of a firm phase and a conditional phase.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open,
on equal terms, to all natural persons and legal entities from the
European Union Member States and from the ACP countries and territories,
irrespective of whether they are taking part as individuals or in a
grouping (consortium) of tenderers (see point 21 also). All the goods
supplied under this contract must originate in these countries.
9. Grounds for exclusion: Tenderers must provide a signed declaration,
included with the tender form for a works contract, confirming that they
are not in any of the situations listed in section 2.3.3 of the Practical
Guide to contract procedures in the context of external actions.
10. Number of tenders: Tenderers (including other companies considered in
law to be part of the same group, other members of the same consortium and
subcontractors) can only submit 1 tender per lot. Tenders for part of a
lot will not be considered. Tenderers may state in their tender whether
they would grant a discount should they be awarded several lots. Tenderers
cannot submit a variant tender in addition to their tender for the work
required in the invitation to tender dossier.
11. Tender guarantee: Tenderers must furnish a tender guarantee for EUR
100 000 per lot when they submit their tender. This will be returned to
unsuccessful tenderers once the invitation to tender procedure has been
completed and to the successful tenderer(s) once the contract has been
signed by all parties. This guarantee will be drawn on if the tenderer
does not honour all the obligations stipulated in the invitation to
tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: An optional briefing and site visit will
be arranged for 26.8.2008 (8:30), starting from the premises of the
Direction générale de l'urbanisme et de la réforme foncière (DGURF).

Tenderers will receive a certificate of attendance at the end of the
visit.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Time limit for completion: The time period for performance of the
works is 21 months from the start date; 18 months for the works in the
firm phase plus 3 months for the conditional phase.
Selection and award criteria
16. Selection criteria: Tenderers whose tenders are deemed to be
administratively compliant will be judged in the following 4 areas:
(a) financial standing;
(b) their experience;
(c) managerial staff;
(d) methodology and equipment envisaged.
The selection criteria are specified in the instructions to tenderers
appended to the invitation to tender dossier.
17. Award criteria: Price.
Tender submission
18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier can be obtained from the contracting
authority:

(route de l'aéroport), Cotonou (Republic of Benin), against payment of EUR
305 into account No B66/01/001/HOR586/21 (account name: 'Produits de vente
des DAO — Travaux 9e FED'), held at the 'Service épargne de la recette
générale des finances' at the Direction générale du Trésor et de la
comptabilité publique in Cotonou. This price does not include carriage
charges.
It can also be consulted on the premises of the contracting authority or
downloaded free of charge from the EuropeAid web site at:
http://ec.europa.eu/europeaid/cgi/frame12.pl.
The standard tender form enclosed with the invitation to tender dossier
must be used to draw up tenders, and the clauses and format of this form
must be strictly adhered to.

The letter must quote the publication reference in point 1 and arrive at
the contracting authority's address no later than 21 days prior to the
final date for submission of tenders given in point 19.
The contracting authority must reply to the questions no later than 11
days prior to the final date for submission of tenders. Possible
clarifications regarding the invitation to tender dossier will be
published on the EuropeAid web site at the following address:

19. Final date for submission of tenders: 29.10.2008 (16:00).
Applications must be sent exclusively to the contracting authority:
— either by registered post (official postal service), to the following
address:

— or by bearer (express courier services in particular), delivered
straight to the contracting authority, in return for a signed and dated
acknowledgement of receipt, at the following address:

The contract title and the contract notice number (see point 1) must be
clearly marked on the envelope containing the tender and must be quoted in
all subsequent correspondence with the contracting authority.
Tenders received after this deadline will be rejected.
20. Tender opening session: Tenders will be opened in public on
30.10.2008 (9:30) in the large conference room of the Cellule FED,
Ministère de l'économie et des finances.
21. Legal basis: ACP-EU Cotonou Partnership Agreement signed on
23.6.2000, as amended on 25.6.2005.
Decision No 2/2002 of the ACP-EC Council of Ministers of 7.10.2002
regarding the implementation of Articles 28, 29 and 30 of Annex IV to the
Cotonou Agreement and its Annex, published in OJ L 320 of 23.11.2002.
