Contract specifications
6. Contract description: The contract covers delivery, assembly and
commissioning by the successful tenderer of the following equipment for
dredgers and hydrography equipment, in 4 lots:
lot 1: hydrographic data acquisition and processing equipment,
lot 2: motors, equipment and accessories,
lot 3: pumps and accessories,
lot 4: pipes, floats and cables.
This equipment is to be delivered duty paid to the GIE-SCEVN (EIG-joint
navigable waterways maintenance service) at the Brazzaville river port
(Republic of the Congo), within 4 months of contract signature by the
successful tenderer.
7. Number and titles of lots: — Lot 1: hydrographic data acquisition and
processing equipment,
— lot 2: motors, equipment and accessories,
— lot 3: pumps and accessories,
— lot 4: pipes, floats and cables.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open
on equal terms to natural persons and legal entities (irrespective of
whether they are taking part as individuals or as part of a grouping
(consortium) of tenderers) from the ACP countries and the Member States of
the European Union who contribute to the European Development Fund, and
also to international organisations as authorised by the instrument
applicable to the programme under which the contract is financed (see
point 22). All the goods supplied under this contract must originate in 1
or more of these countries.
9. Grounds for exclusion: Tenderers must submit a declaration stating
that they are not in any of the situations listed in section 2.3.3 of the
Practical Guide to contract procedures in the context of external actions.
10. Number of tenders: Tenderers cannot submit more than 1 tender per
lot. Tenders for part of a lot will not be considered. Tenderers may state
in their tender whether they would grant a discount should they be awarded
several lots. Tenderers may submit a variant tender for lot 1 in addition
to their tender for the supplies required in the invitation to tender
dossier.
11. Tender guarantee: Tenderers must furnish a tender guarantee of:
— EUR 6 000 for lot 1,
— EUR 15 000 for lot 2,
— EUR 3 000 for lot 3,
— EUR 3 000 for lot 4,
when they submit their tenders. This will be returned to unsuccessful
tenderers once the invitation to tender procedure has been completed and
to the successful tenderer(s) once the contract has been signed by all
parties. This guarantee will be drawn on if the tenderer does not honour
all the obligations stipulated in the invitation to tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: A briefing and a visit of the
installations and equipment may be organised on 9.10.2008 (10:00) at the
GIE-SCEVN (EIG-joint navigable waterways maintenance service), Port
fluvial de Brazzaville, BP 179 — Brazzaville/Republic of the Congo.

14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Implementation period: 4 months from contract signature.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. Where tenders are submitted by a consortium, these criteria
will apply to the consortium as a whole.
1) Tenderers' economic and financial capacity (based on point 3 of the
tender form for a supplies contract):
— lot 1: annual turnover of EUR 1 000 000 over the past 3 years,
— lot 2: annual turnover of EUR 1 500 000 over the past 3 years,
— lot 3: annual turnover of EUR 500 000 over the past 3 years,
— lot 4: annual turnover of EUR 500 000 over the past 3 years.
2) Tenderers' professional capacity (based on points 4 and 5 of the tender
form for a supplies contract):
— lot 1: tenderers must have had 30 staff members over the past 3 years,
— lot 2: tenderers must have had 100 staff members over the past 3 years.
3) Tenderers' technical capacity (based on points 5 and 6 of the tender
form for a supplies contract):
— lots 1 and 2: tenderers must have carried out at least 3 projects of an
equivalent nature over the past 3 years.
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. These
bodies must comply with the same eligibility rules, in particular
regarding nationality, as the economic operator in question.
17. Award criteria: Price (or, where applicable, following derogation,
the economically most advantageous tender in terms of service
quality/price).

18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier is available from the following web address:

It can also be obtained from the contracting authority. The standard
tender form for a supplies contract must be used to draw up tenders. This
form can be found in the invitation to tender dossier, and its clauses and
format must be strictly adhered to.

19. Final date for submission of tenders: 28.11.2008 (9:00).

Brazzaville, BP 179, Brazzaville, Republic of the Congo.
21. Language for the procedure: French must be used for all
correspondence concerning this invitation to tender.
22. Legal basis: ACP-EC Partnership Agreement signed in Cotonou on
23.6.2000, as amended in 2005.
